His friend [redacted] was with him at the time. [redacted] exited his vehicle and went into the convenience store. After making his purchase, he got back into his vehicle and started to drive away. Two plainclothes officers, PO Jay Poggi and PO Michael McCarthy of the 101st Precinct, pulled up in an unmarked vehicle and stopped [redacted] and [redacted] (Allegations A and B: Abuse of Authority – Vehicle stop, [redacted]). PO Poggi approached [redacted] on the driver's side of his vehicle and ordered him to exit the vehicle. When [redacted] did not exit the vehicle, PO Poggi told him, \"I'm going to fucking pull you out of that door if you don't get out of the car.\" He also told [redacted] \"Step out or I'm going to rip you out\" (Allegation C: Abuse of Authority – Threat of force, [redacted]; Allegation D: Discourtesy – Word, [redacted]).\n\n[redacted] exited his vehicle. Once he was outside, PO Poggi allegedly forced him to the ground. PO Poggi allegedly punched and kicked [redacted] several times while he was on the ground. He then allegedly dragged [redacted] along the ground to the rear of his vehicle (Allegation E: Force – Physical force, [redacted]). PO Poggi allegedly frisked [redacted] while he was still on the ground (Allegation F: Abuse of Authority – Frisk, [redacted]).
