Mizell was, without just cause, wrongfully assaulted by the defendant officers. Mizell's assault took place while he was being falsely arrested for a violation of an order of protection, which has been disposed of. Despite Mizell not having committed any crimes, nor any probable cause, individual defendants stopped and arrested him. Following Mizell's arrest, defendants transported him into the building stairwell where the officers viciously beat, and assaulted him while dragging him down seven flights of stairs. In areas with no security cameras, defendants battered, beat, and abused Mizell, without risk of their misdeeds being recorded. Mizell was taken to the 120th precinct where he was denied medical treatment despite repeated requests and pleas. Mizell was later transported by ambulance to Richmond University Medical Center. The officers told plaintiff that they had mistakenly arrested his friend earlier and meant to arrest him on an alleged outstanding warrant.  The contents of plaintiff's pockets were removed.  Plaintiff had no alleged contraband or weapons.  He was placed in a jail cell, and then was unlawfully strip-searched in the precinct bathroom by defendant officer Jonathan Kane, under the supervision of officers Walls and Jacques, without any reasonable suspicion or justification.
