Despite being handcuffed and subdued, the officers continued to physically assault him, resulting in serious injuries. Spann was also subjected to an illegal search, which yielded no contraband. He was later transported to the NYPD-73rd Precinct and detained before being released after prosecutors declined to press charges.\n\nA similar incident occurred on August 25, 2019, where Spann was again arrested without cause near the corner of Mother Gaston Boulevard and Sutter Avenue in Brooklyn. During this arrest, the officers kicked and tripped him, causing him to fall and sustain further injuries. Spann was once again tightly handcuffed and beaten by the officers, who ignored his requests for medical treatment. The officers searched the home without a warrant and failed to find anything illegal on Plaintiff’s person or in her reach. Plaintiff was taken to the precinct and subject to a DNA sample collection. Plaintiff suffered panic attacks while being held in the cell before being rushed to medical attention where she received supervision and an IV. Plaintiff remained in the precinct cell for approximately four days before being taken to Central Booking. All charges against Plaintiff were favorably dismissed on September 27, 2018. \n\nOn or about July 1, 2017, Plaintiff, Mr. Bruce Comas, was in his mother’s home when P.O.s including Officer Pawel Lachowski, pursuant to a warrant obtained via false information offered by a confidential informant, entered into the apartment and drew a gun on him. Plaintiff was not aware of any contraband or firearm in the apartment, as the officers alleged. P.O.s including Lachowski and Sicari, committed multiple assault and batteries to Plaintiff’s person, including handcuffing him tightly and grabbing, pushing, and shoving him. Plaintiff was placed in a cell at the precinct for approximately seven days before being taken to Central Booking.
