In response, PO Yadimar Pena, Osvaldo Garcia, Grant Pulgarin, and John Does 1-4 assaulted Plaintiff by grabbing, tackling and throwing her to the floor, making racist and sexual statements to her, dragging her across the floor of the precinct, and smashing her body into desks in the lobby. Officers handcuffed Plaintiff too tightly and unlawfully arrested and searched her, despite Plaintiff's request a female officer conduct the search. $10,000 worth of property was removed from Plaintiff and never returned. An EMS worker advised POs that Plaintiff needed emergent medical treatment; she was taken to the hospital, but POs told medical staff she was \"refusing medical treatment,\" over her request to see a doctor. Plaintiff was eventually seen by an MD who advised POs loosen Plaintiff's handcuffs. Plaintiff was returned to precinct and her request to call an attorney was ignored. All 7 POs fabricated evidence and initiated a malicious prosecution against plaintiff, to cover up their actions. As a result, Plaintiff was arraigned for assault and resisting arrest. Her case was eventually dismissed.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=fcbLzvTvTHMjMbjvELtSFw==","type":"complaint"}]},{"name":"Jobe-Simon, Mawule vs City of Ny, et al.","start_date":"2023-10-05","payout_amount":0,"disposition":"","docket":"159313/2023","court":"Supreme Court - New York","summary":"On July 2, 2022, Plaintiff was lawfully present in the hallway of his apartment building when Defendant Police Officers approached him without justification. They began to question him, when one of the Defendants suddenly grabbed Plaintiff, pushed him backwards, and slammed the back of his head into the door frame, causing Plaintiff to begin bleeding. Plaintiff was then placed in overly-tight handcuffs and physically dragged out of the building and into an ambulance. To drag Plaintiff, Defendants grabbed him by his dreadlocks (which are religiously significant to Plaintiff), tearing some of them out in the process. Defendants provided false information to take Plaintiff to a hospital, where he received medical care.\n\nA week later, on July 9, 2022, other Defendant Police Officers came to Plaintiff's apartment. They had him step outside, then arrested him for \"mental health reasons\" without justification. Plaintiff was placed in overly-tight handcuffs, and Defendants refused to loosen them. Plaintiff had an unrelated foot injury, and one of the Defendants kicked him in that leg, causing further pain and injury. Plaintiff was then again dragged to a hospital against his will; more of his dreadlocks were ripped in the process, while the staples from his last injuries were also dislodged. Defendants gave false statements that caused Plaintiff to be held at a normal hospital until July 11, then at a psychiatric facility under an involuntary hold until July 16, 2022.","documents":[{"url":"https://iapps.courts.state.ny.us/fbem/DocumentDisplayServlet?documentId=njc2sgLbFvrox3bcgXJf2g==&system=prod","type":"complaint"}]}],"discipline":[{"disposition_date":"2024-05-03","case_no":"2023-29482","recommendation":"Command Discipline - A","allegations":[{"desc":"Wrongful removal to a hospital."}]},{"disposition_date":"2024-05-02","case_no":"2022-26506","recommendation":"Training","allegations":[{"desc":"Wrongful entry of a premises."},{"desc":"Wrongfully deactivated their body worn camera."}]}],"documents":[{"url":"https://www.documentcloud.org/documents/22086370-seh_965430","type":"employment-history"}],"image":"https://www.50-a.org/images/officer/33SB-grant-pulgarin.jpg","payroll":{"salary":"109352","regular":"108510","overtime":"39926","other":"23756","total":"172193"},"id":"33SB","url":"https://www.50-a.org/officer/33SB"}
