The plaintiff was unaware of the officers because the two vehicles driven by the defendants (one driven by Officer Rodriguez) were both unmarked, and all defendants were in plain clothes at the time. The defendants then drew their guns on the plaintiff, causing him to stop out of fear. Afterward, the defendants approached the plaintiff’s vehicle without lawful reason and instructed him to step out and present his driver’s license and vehicle registration. The plaintiff respectfully complied and presented both, which were valid at all relevant times. The defendants then began to question him but unlawfully seized him. Later, the defendants, including Officer Rodriguez and other officers, assaulted and battered the plaintiff multiple times, including by placing handcuffs on him too tightly. Subsequently, the defendants forcibly removed the plaintiff from his vehicle and transported him to the NYPD 44th Precinct, all without his consent or probable cause. Upon arrival, the plaintiff remained handcuffed in the unmarked vehicle in the precinct’s parking lot. The plaintiff was unlawfully detained with handcuffs in the back of the vehicle for approximately six hours and in a cell with handcuffs on for about an additional hour. The defendants eventually returned the plaintiff’s car to him, but it was severely damaged and no longer operable. On the same day, the defendants also illegally entered and searched the plaintiff’s mother’s residence at 1420 Shakespeare Avenue, Apartment 1A, in Bronx County. No illicit items were found in any of these searches. \n\nThroughout the entire process, the defendants never read the plaintiff his Miranda rights. Additionally, the defendants engaged in bad faith conduct to fabricate false evidence, not only to use excessive force against the plaintiff but also in furtherance of the plaintiff’s wrongful arrest and subsequent malicious attempt at criminal prosecution. Meanwhile, they failed to intervene when observing others doing so. The defendants never provided truthful facts to the DA’s Office or the presiding judge to justify the issuance of a valid search warrant. The only warrant granted was to search the plaintiff's car.
