The POs transferred him from the hospital to the precinct, away from hospital staff who could monitor and treat him, without explaining why he was being arrested. While Plaintiff was in custody, the POs provided false information to the District Attorney, specifically that he had engaged in felony crimes. \nThe POs transferred Plaintiff to Central Booking in a hospital gown without shoes. He was not allowed to appear in front of a judge without shoes, but the POs told him his shoes were evidence. They gave him a stranger's size 7 shoes to wear before the judge; Plaintiff is a size 12. Bail was set at $100,000, and Plaintiff was sent to Rikers, where he was not provided with medical treatment until six hours after his arrival—he was denied pain medication as well as a doctor visit, and his health was unmonitored. He offered his house as collateral in exchange for a bail bond, and he was released on April 21, 2019. Defendant Officers Cruzado and Alexandros Kalogiros also fabricated evidence, including claims that Casas positively identified Plaintiff as his assailant, Casas positively identified Plaintiff in a photo array, and Casas identified Plaintiff in a lineup. Defendant Officers Cruzado and Kalogiros also ignored evidence that tended to exculpate Plaintiff, including initial statements by Casas that he neither recognized nor could identify his assailants, the existence of alibi witnesses who would have established Plaintiff's whereabouts at the time of the attack on Casas, and the existence of phone and GPS records that would have established Plaintiff's whereabouts at the time of the attack on Casas. Plaintiff was subjected to very high bail and was incarcerated for a period of fourteen months.
