The officers ordered plaintiff out of the car, searched plaintiff and arrested him by violently contorting his arms and tightly affixing his wrists with handcuffs, despite no reason to believe that plaintiff was committing any crime or violation of law. Plaintiff was then transported to the 47th precinct, where he was photographed, interrogated, and strip-searched despite no reason to suspect that he was carrying firearm or stolen property.  Defendant officers then fabricated evidence to be used against plaintiff, including that he was carrying firearms, which resulted in criminal prosecution against plaintiff without any probable cause. Plaintiff began to walk down 188th Street. He was not behaving in a suspicious manner and he was not ducking behind cars. There was no visible indication of a handgun on his person. Plaintiff continued to walk down 188th Street when NYPD police officers in plain clothing jumped out of a vehicle and began to run towards him without identifying themselves as police officers. Sgt. Michael Whelan and Officer Valdrin Nikqi observed Plaintiff walking down the street, but at no time did they observe him commit a crime or behave in a manner than would lead them to believe criminal activity was afoot. Whelan and Nikqi, dressed in plainclothes and armed with service weapons, began to chase Plaintiff without identifying themselves as police officers, before chasing him into 373 East 188th Street, Bronx, NY where he was grabbed, tackled to the ground and searched without probable cause. He was taken to the 46th Precinct, then to Central Booking, and was arraigned on charges of Criminal Possession of a Weapon and other related charges. Plaintiff remained in custody for over seven months until the US Attorney for the SDNY filed a Nolle Prosequi on October 26, 2018 and the Bronx County DA's Office dismissed the charged on October 31, 2018.
