This attack took place immediately after Plaintiff and his wife warned Defendants Police Officer Jose Rodriguez and Police Officer Neon Chowdhury that these neighbors were acting in a hostile and aggressive manner. Plaintiff was attacked directly in front of Defendants PO Rodriguez and PO Chowdhury. Even as Defendants intervened, the attackers refused to relent and Plaintiff continued to get punched and kneed. Defendants accused the group as a whole of fighting, even though Plaintiff was being jumped. \n\nShortly after, one of the attackers grabbed an aluminum bat and charged at Defendant Rodriguez - who was standing in front of Plaintiff. Plaintiff bolted down the street and was chased by the attackers. Defendant Rodriguez followed the group of attackers at a leisurely walking pace and Defendant Chowdhury did nothing. As the attackers caught up to Plaintiff, he was in fear for his life as the Defendant police officers were well behind them. Plaintiff stabbed one of the attackers in the stomach. Defendant Rodriguez did not detain any of the attackers or attempt to secure the bat in their possession, even after witnessing the criminal acts. Instead, Defendants told the attackers to return to their house. When other officers arrived at the scene, Officer Rodriguez told Plaintiff to shut up and falsely insisted to arriving officers that Plaintiff was the blameworthy culprit. Defendants Almontepichardo, Rinaldo, Liberatore, Gomera, Marrone, and Rivera, among others, responded to the scene and participated with Defendants Rodriguez and Chowdhury in an investigation of what had happened. When she opened the door, she was confronted by PO lieutenant Brian Query, and police officers Macciel Restituyo, David Perez, Lissa Solermarte, Praveen Davis, Alex Almonte Pichardo, Jason Gonzalez, Daniel Reisert and Flamur Gashi. The officers, who had received a 911 call, demanded to speak with the nephew and then, without a warrant or consent, barged into the apartment. Once inside, lieutenant Query asked Lee where her nephew was, and she responded that he was in his room. The officers then approached the nephew’s room, and PO Solermarte, Query, and Restituyo drew their tasers, even though the nephew posed no threat. Plaintiff, hanging back, asked the officers not to tase her “child.” In retaliation, lieutenant Query instructed the officers to arrest Plaintiff for obstruction of governmental administration. The officers did so – and they refused to tell Plaintiff that she was under arrest while handcuffing her, taking her to a squad car outside and driving her to the local precinct. The officers held Plaintiff at the precinct and questioned her for hours. When her blood pressure rose alarmingly, she was brought to a hospital and shackled to a bed there for hours more. Plaintiff was arraigned on December 5, 2021, and released on her own recognizance. In support of the charges, prosecutors presented a criminal complaint signed by PO Restituyo on December 4, 2021, which contained multiple demonstrably false statements made by officers. After Plaintiff’s release, she faced prosecution for months before the DA dismissed the charges on May 18, 2022, “in the furtherance of justice”. The Defendants, NYPD Police Officer Alex Almontepichardo, NYPD Police Officer Brown, and NYPD Police Officers \"John Does 1-5,\" were driving their NYPD motor vehicles carelessly, recklessly, and negligently at the intersection. Because the traffic light at the intersection for the Plaintiff was green and indicated he had the right of way, he approached the intersection. However, one of the Defendants' NYPD vehicles crossed unexpectedly in front of the Plaintiff's car and caused him to stop his vehicle. Soon after, a second NYPD vehicle driven by the Defendants ignored the green light and forcefully struck the Plaintiff's vehicle on its passenger side in a hard T-bone impact. At no point were the Defendants responding to any emergency since no emergency sirens, warning lights, or light packs sirens were on any of the vehicles. \n \nAn ambulance took the Plaintiff to St. Barnabas Hospital. Once Plaintiff woke up at the hospital, he saw that his left wrist and legs were handcuffed to his hospital bed and that Defendants NYPD Officer Brown and John Does 1-5 were next to his bed. At the hospital, the Defendants joked about the Plaintiff's questions about what happened and his inability to respond to what happened to him at the accident site. At no point did the Defendants read the Plaintiff his Miranda rights. Plaintiff stayed handcuffed at the hospital for almost the entire five hours he was at the hospital without any probable cause, reasonable suspicion, and/or justification. After the Plaintiff left the hospital on September 13th, 2021, the Defendants took him to the 42nd precinct, where he was searched, photographed, and placed in a holding cell in his hospital gown since the Defendants lost all his clothing and shoes. After staying there for an hour and a half, the Plaintiff was transferred to Central Booking where he was again processed in his hospital gown and remained in a holding cell for several hours. At approximately 7:00 pm on September 13, 2021, a Correctional Officer came to the Plaintiff's holding cell and told him that he was free to go. However, Plaintiff was not given any paperwork other than a property voucher and an invoice from the precinct. Plaintiff was never officially charged or prosecuted despite being handcuffed, unlawfully detained, unlawfully imprisoned, and falsely arrested.
