Mr. Pentenrider made this allegation in retaliation for a report made by Plaintiff that Mr. Pentenrieder and his wife were abusing their child. \n\nPO Brogan prepared a police report based on Mr. Pentenrieder's false information and PO Danilo Cruz conducted a telephone interview with Mr. Pentenrieder in which Mr. Pentenrieder falsely informed PO Cruz Mr. Petenrieder was conducting an affair with Plaintiff, and the reason for his delayed reporting was that he did not want his wife to know of the affair. Without further or proper inquiry, PO Cruz arrested Plaintiff on November 14, 2017 and took her to the 45th Precinct, where she was criminally processed and held for 24 hours. Plaintiff has a history of physical and mental anxiety that PO Cruz intentionally exacerbated by filing these criminal charges. After multiple court appearances all charges were favorably dismissed on January 16, 2019.
