When Plaintiff stopped directly behind the NYPD vehicle, Defendant officer ESPINAL, who was in the process of writing court summonses to cyclists at the time, demanded that Plaintiff give him his ID. After Plaintiff refused on the grounds that there was no lawful basis for the stop, officer ESPINAL tackled Plaintiff to the ground at which time another officer removed Plaintiff's ID without consent from Plaintiff's back pocket. Plaintiff was handcuffed and arrested and taken to Midtown South Precinct where he spent 13 hours in custody before being released on his own recognizance.
