Defendants arrested and detained Plaintiff. A Defendant supervisor was present on the scene and did not stop Plaintiff's arrest. Earlier on September 30, 2019, Plaintiff reported to police he was a victim of an assault inside the location, showed his injuries, invited them to view video supporting his claim, provided witness names, but was ignored. On October 1, 2019, Defendants went to the location and conducted an insufficient investigation. As a result of Defendants' efforts, Defendants sought to arrest Plaintiff. The day of plaintiff's arrest, he offered to defendants to view video and provided witness names to the encounter but was ignored. Defendants tightly handcuffed plaintiff. Defendants refused to adjust the handcuffs despite Plaintiff’s repeated requests. At the Precinct, Plaintiff was subjected to a search of intimate parts of his body. Plaintiff was charged with assorted crimes. Plaintiff was detained for twenty-four hours before being released. Defendants prepared false affidavits and police reports to the NY DA, who charged Plaintiff with several charges. Plaintiff then approached his vehicle and observed that the vehicle was unlocked when opened the door without using his keys when Defendants, including Defendant Officer Nathalie Fernandez and/or Officer Jane Doe then illegally approached Plaintiff, unlawfully reprimanded him for approaching his car, and demanded that he speak to police officers inside the precinct. Plaintiff then complied and entered the precinct and was told by Defendant Officers, Timothy Collins, Albert Barbosa, and other unnamed officers that his vehicle was in police custody, that he needed to return to the precinct with the register owner of the vehicle to retrieve his vehicle from police custody, but failed to mention the reason as to why his vehicle was in their possession. Plaintiff then complied and left the vicinity of this complained-of-incident to bring his father to the precinct. The Plaintiff returned with his father and the defendant officers approached the Plaintiff and then unlawfully questioned him about his vehicle. Plaintiff then communicated to the defendant officers that he placed a tracker in hi vehicle because he rents the vehicle out to other people. At the direction of Defendant Officer Fernandez the above-mentioned officers seized the Plaintiff by aggressively grabbing him and searched his person. No contraband was found. Plaintiff's arms were contorted behind his back and handcuffs were tightly affixed to his wrist. Plaintiff complained of the handcuffs bing too tight but his requests to loosen them were ignored. When asked why he was being arrest his was told because Defendant Fernandez ordered them to. Plaintiff was them fingerprinted, photographed, questioned without counsel, searched and strip-searched with attendant cavity inspection, detained in a dank and dirty cell for approximately twenty-four (24) hours. Plaintiff was then transported to Central Booking where he was photographed, searched, and illegally detained throughout various dank and dirty cells for approximately twelve (12) hours before being released from physical custody after his\narraignment.
