The police had plastic shields over their bodies and told plaintiff to get down. They handcuffed Plaintiff and took her into the living room and put her on the couch. They asked Plaintiff where the son's room was and Plaintiff told them. The police drew their guns and confronted the son and his girlfriend and pointed guns in their faces. The son was handcuffed and taken downstairs to the van while the girlfriend was handcuffed and put on the couch. The police then searched the apartment and yielded one bag of marijuana from inside the cigarette box on top of the son's room and a clear twist with crack cociane on top of the medicine cabinet in the bathroom. The police broke the front door of the apartment, damaged the bed and dresser in the son's room as well as part of the couch, and dressers in Plaintiff's room. The plaintiff was held on her couch for about 40 minutes while the police searched her apartment. The plaintiff and the girlfriend were then taken to the van. The plaintiff, her son and his girlfriend were in the van for about 3 hours until it came to the 25th precinct. At the 25th precinct the plaintiff was fingerprinted and photograpehd and was released 2 hours later  on July 31, 2013, and given a desk appearance ticket. Plaintiff's son and girlfriend were taken from the 25th Precinct to central booking for arrest processing and arraignment on misdemeanor charges. Pliantiff returned home and since the police had broken plaintiff's door while in the apartment the door was not able to be locked. Plaintiff came back home and found a strange man in her apartment who did not have permission to be there. Plaintiff found many numerous items missing from her apartment. Plaintiff came to Criminal Court and was told that the NY DA had declined to prosecute her. Plaintiff sustained financial loss as a result of her property being damaged by the NYPD.
