Nonetheless, defendant Ledlon approached Z.R. and told her she could not sit in the public seating area of the restaurant. Z.R. observed that only African American teenagers were told they could not sit in the designated area. She asked why she could not sit after purchasing food and Ledlon did not offer an explanation. Defendant NYPD officers then arrived and ordered all students inside the Wendy’s to leave the premises. Z.R was packing her things to leave when an officer grabbed her sandwich and threw it away. An officer grabbed her arm and others surrounded her. They slammed her to the floor and aggressively handcuffed her while her backpack was still on. \n\nZ.R. was transported to a precinct, fingerprinted, placed in a holding cell, and subjected to an invasive search. She was charged with Obstructing Governmental Administration in the Second Degree, Resisting Arrest and Trespass. The officers filled out false and/or misleading reports and forward the false information to the Queens County District Attorney’s Office. Z.R. spent around 24 hours in custody. Plaintiff took possession of the property, made significant renovations, and was to purchase the residence, but defendants reneged on their agreement and forced plaintiff from the property through harassment and intimidation.\n\nOn May 31, 2014, plaintiff and her partner were packing their luggage to visit Maryland. One of the defendants came to the property and started an argument with plaintiff. Plaintiff had dropped her phone during the argument and picked it up before heading back inside the residence. Defendant called 911 and claimed that plaintiff had stolen her phone. \n\nFour defendant officers, including defendant officer Richard Phipps, arrived and arrested plaintiff on the charge of stealing a cell phone. Plaintiff cooperated with officers and was taken to the 105th precinct before Central Booking. She was arraigned and released on her own recognisance. Defendant pressured the police officers to issue an assault charge and claimed that plaintiff hit her with an iron object and bruised her head. \n\nPlaintiff was re-arrested for the assault charge after being lured to the 105th precinct under the guise of filling out paperwork on June 1, 2014. Plaintiff requested medical aid and was denied. Plaintiff was then put on the street without seeing a judge. The assault charge was dismissed and sealed by the prosecutor’s office.
