On August 29, 2013, POs John Repetti and John Doe, who had previously falsely accused her of assault, approached her as she was lawfully selling ice cream and arrested her without probable cause, affixing excessively tight cuffs to Plaintiff's wrists. Plaintiff and her granddaughter asked why Plaintiff was being arrested and were both told to \"shut up.\" POs threw out Plaintiff's entire supply of ice cream and put the cart in a police van. Plaintiff was punched and placed in a police car without air conditioning and water, despite it being a very hot and humid day. \n\nWhen Plaintiff arrived at the 52nd Precinct she fainted from dehydration. Throughout her unlawful imprisonment Plaintiff repeatedly requested water, blood pressure medication, and food but was never provided any despite the fact Plaintiff told POs she was a diabetic. Plaintiff was arraigned on August 30, 2013, at which time she learned she was charged with, inter alia, failure to possess a general vendors license. The case was dismissed on October 18, 2013. POs never returned various items from Plaintiff's vendor cart.
