The officers approached the taxi with guns drawn, and pulled Plaintiff Rodriguez out of the car. HE was then searched intimately in public, including touching his private organs and his buttocks. A different occupant of the vehicle was searched and the police officers found a bag of marijuana. Instead of charging that passenger, the police officers chose to charge Plaintiff Rodriguez with possession of marijuana. They handcuffed Plaintiff Rodriguez and placed him in the back of the squad car, and Officer James Tobin called Plaintiff a “piece of shit”. He was driven to the precinct and during the trip, the police officers continued their verbal assault of Plaintiff Rodriguez. At the precinct, Plaintiff Rodriguez was subjected to a strip search and was called “fucking stupid”. He was held for eight hours in an unsanitary cell. Plaintiff was charged with possession of marijuana and resisting arrest. \n\nOn October 15, 2016, Plaintiff Rodriguez was driving when he was stopped without cause by Police Officer Shawn Morris. As Officer Morris approached the driver’s side window, Plaintiff Rodriguez attempted to call his attorney Officer Morris took the phone out of Plaintiff Rodriguez’s hand and pulled him out of the vehicle. He was arrested and charged with criminal possession of a controlled substance, criminal possession of marijuana, unlawful possession of marijuana, and resisting arrest.
