Plaintiff had grown up in this apartment, which his mother rented, and had been living there continuously for 12 years, though his mother had passed away in 2020. Defendant NYCHA employees, despite being aware of plaintiff's continuous residence at the apartment, began to drill open the lock to enter the apartment. Once they succeeded, defendant NYPD Officer Patrick Buckley and four John Doe officers entered the apartment and forcibly removed plaintiff. They arrested him on charges of trespass, and took him into custody at the 79th Precinct. While he was in custody, defendants returned to the apartment and searched it. Plaintiffs charges were dismissed after his arraignment.
