The car stopped and NYPD Officer Jorge Minier got out and ran toward Plaintiff and without probable cause ordered Plaintiff to stop asked where he was going and asked for identification. Plaintiff said he was going home and gave Minier his identification, and then Minier tried to grab the plastic bag that Plaintiff was carrying. Plaintiff blocked Minier and rand down Freeman street. Minier chased Plaintiff while his partner followed in the car. Minier caught up to Plaintiff lunged at him and tackled him to the ground. Minier then put his knee on plaintiff's back and pushed the right side of Plaintiff's head into the ground and handcuffed him. Minier then without a warrant searched Plaintiff's black bag and pulled out a small bag of marijuana and then yelled at Plaintiff \"You made me run for fucking weed\"?. Minier then punched Plaintiff many times in the head and hit his jaw and left ear. Minier then forced Plaintiff's head into the ground and used it as leverage to get to his feet. Plaintiff was put in the back of the patrol car and driven to the 43rd precinct and was put in a holding cell. Minier signed a criminal complaint charging Plaintiff with criminal counts. The complaint featured false statements and said Plaintiff had 11 bags of marijuana when he only had one. Plaintiff at the precinct made requests for treatment for the injuries caused by Minier and was then taken to the hospital by ambulance. At the hospital Plaintiff got treatment for the injuries but he complained of a throbbing tooth that they did not treat. Platiniff was taken back to the precinct and he met with an internal affairs officer where he identified minier from photographs. Plaitniff was then taken at 12 pm on April 24, 2015 to bronx central booking and was then arraigned that evening and released at 11 pm. In July 2015 Plaintiff's tooth was removed by a dentist because it was injured by Minier. On August 21, 2015, after making 3 court appearances, Plaintiff accepted an adjournment in contemplations of dismissal.
