Plaintiff then curled on the sidewalk in a defensive position while the unidentified officer beating him from above.  Defendant Officer Joseph Abel exited an unmarked van and joined the assault, placing Plaintiff in an illegal chokehold.  Defendant Abel pinned Plaintiff’s injured arms behind his back, handcuffed him and moved Plaintiff to a van for transportation to the 25th Precinct.\n\nPlaintiff repeated asked for medical attention but was told it would wait until he was processed.  Plaintiff was eventually taken to a hospital by ambulance and treated for an injured wrist.  There he was visited by internal affairs officers, a statement taken, as were photographs.  Plaintiff was eventually arraigned for selling drugs on November 30, 2010.  Plaintiff was again treated on December 20 and after x-rays was diagnosed with a fractured wrist.  Still in custody, Plaintiff had wrist surgery on December 28. Defendants removed Plaintiff from his car and searched his vehicle. Plaintiff sustained injuries from being forcibly removed and being handcuffed too tightly. Plaintiff told the detectives he had a serious heart condition and needed his medication, but the detectives ignored him and deprived him of the medication for several hours. The detectives then forced Plaintiff into a van and brought him to the precinct. Plaintiff was charged with possession of a controlled substance in the third degree and criminal possession of a controlled substance in the seventh degree. Detective Lamagra falsely swore in a criminal court affidavit he observed the Plaintiff exchange an unidentified small object for money. Plaintiff was held in police custody for approximately one week. Plaintiff's charges were dismissed on May 5, 2011 after having to make several court appearances to defend himself. \n\nOn October 29, 2010, Plaintiff was in his car when officer defendants, including Detective Baez, approached Plaintiff and assaulted him. They struck Plaintiff's head with a handgun and repeatedly struck his head with a baton. They threatened to shoot and kill Plaintiff while he was still in his car. Defendants handcuffed Plaintiff's left hand to the interior of the car door and his right hand to the steering wheel, continuing to strike him even after he was handcuffed. Plaintiff sustained multiple injuries and was taken to the precinct. Plaintiff was charged with attempted tampering with physical evidence and criminal possession of a controlled substance in the seventh degree. Detective Baez falsely provided information to the court swearing he had observed a separately charged defendant sniff heroin after obtaining it from Plaintiff's hand and sweater.
