A higher ranking officer arrived at the scene and ordered Plaintiff to take a breathalyzer test. Plaintiff refused because he was not driving and was only in the passenger seat. Plaintiff was then arrested and taken to the 52nd Precinct, where he was then taken to central booking and charged with a DUI.
