After a verbal dispute, Plaintiff’s wife left the scene. Plaintiff called her to check on her whereabouts and the phone was answered by a P.O. at the 33rd Precinct. The officer informed Plaintiff that his wife and kids were at the station. Plaintiff arrived at the station but the officer refused to let him see him family. Plaintiff was also not allowed to leave and soon, ten P.O.s surrounded and arrested Plaintiff while his 6 year old daughter watched. Plaintiff was accused by Officer Randazzo of abusing Plaintiff’s 15 year old stepdaughter and causing redness to her neck, scratches on her ankle, and “dragging her out of the bedroom.” Officer Randazzo took fabricated photos of the “injuries” but did not take the children to the hospital. \nOn August 29, 2019, CPS Officer Diana Alama submitted a sworn petition against Plaintiff in Family Court, alleging that Plaintiff dragged his stepdaughter by the collar, causing her to suffer scratches and bruises. Alama forced Plaintiff’s family to go to the emergency room so that Plaintiff’s children could have a medical exam performed by a pediatrician. The doctor found no injuries or marks. \n\nPlaintiff’s criminal case was dismissed on November 25, 2019. That day, Alama visited Plaintiff’s home and inspected his children. Plaintiff brought children to the front door and showed Alama a copy of the case dismissal. An hour later, Alama returned with members of the NYPD and presented a P.O. with an ex parte restraining order, which Plaintiff had never been served with. Plaintiff was arrested in front of his family. On February 7, 2020, without Plaintiff’s knowledge or consent, Alama and A.C.S. removed the children from Plaintiff’s home regarding a different matter in which Plaintiff’s wife was facing allegations of abuse. \n\nPer court order, Plaintiff had permission to his biological daughter after school on February 12, 2020 with a resource. Plaintiff provided Alama with a picture of his cousin, Charles Butler, who was permitted to pick up Plaintiff’s daughter from school. Alama failed to inform Defendant Wandaly Torres, parent coordinator for P.S. 173 M, of the approved resource, and Torres denied Butler access to Plaintiff’s daughter. Plaintiff showed Torres text messages indicating Butler as an approved resource, but Torres and Defendant Rachael Garcia, principal of the school, called 911.
