The Plaintiff was then taken to Central Booking to await arraignment.\n\nWhile in Central Booking, Defendant Lallave and Defendant Maloney conveyed false information to prosecutors, in order to have the Plaintiff charged with: Criminal Sale of a Controlled Substance in the Third Degree, Criminal Possession of a Controlled Substance in the Third Degree, Criminal Possession of a Controlled Substance in the Fifth Degree, and Criminal Possession of a Controlled Substance in the Seventh Degree. The Plaintiff, who did not possess or sell heroin or engage in illegal conduct on April 19, 2013, was arraigned on those charges and spent approximately 30 hours unlawfully in police custody. At arraignment, the Honorable Judge Parker released the Plaintiff on his own recognizance and the matter was adjourned for grand jury action. On June 6, 2013, the Plaintiff was indicted by a Kings County grand jury. Some of Peters' dreadlocked hair was pulled out. Peters informed the officers his hand was injured. Peters was handcuffed and taken to the 77th Precinct, and his pleas for medical attention for his hand were ignored, with the officers made racial slurs toward Peters. If indeed true that the officers had obtained a search warrant, such a warrant was only obtained by misleading and misinforming the judge. The officers searched the premises, and nothing illegal was recovered. The officers claimed that they had recovered a \"scale\" and empty \"baggies\", but that was not true. Plaintiffs were taken out in handcuffs and brought to the precinct where they were imprisoned for several hours. \n\nThe Plaintiffs were released with desk appearance tickets that mandated that they report to court to defend themselves against criminal charges of \"Criminally using Drug Paraphernalia”. When reporting to court, Plaintiffs were informed that the court was not in possession of paperwork pertinent to their matters. On March 12, 2014, Plaintiffs were told by the court to return home, and call the court after thirty days if they did not receive any paperwork from the court within that time.
