Once Defendant officers entered the apartment, Plaintiffs were arrested and transported to the 61st precinct and then transferred to New York Central Booking. Despite compelling and objective documentation indicating Plaintiffs did not reside in the apartment, Defendant Police Officers falsely and maliciously told the New York County District Attorney’s Office that Plaintiffs had committed the crime of Criminal Possession of a Firearm. Later, this charge was dropped, and plaintiffs were instead charged with Torture or Injury to an Animal which belonged to Jesus and Angelina Torres, who lived full-time in the apartment and were the owners of the dog. Plaintiffs never abused or neglected the animal. During their time in custody, Plaintiff Sutherland was handcuffed to a chair in the 61st precinct for more than 3 hours and Plaintiff Jimenez was handcuffed unnecessarily tightly for 3 hours prior to arriving at the precinct. Plaintiff Sutherland was incarcerated for approximately 17 hours and Plaintiff Jimenez was incarcerated for approximately 31 hours. When Officers Iocco and Del Villar arrived, she told them that her sister, who had a criminal and psychiatric history, and was acting violently and erratically, was in the hotel room. The officers retrieved her bag. Upon receiving her bag, plaintiff emptied it, to check its contents. The officers then grabbed her and shoved her. Plaintiff immediately called 911 to report the misconduct and sought an Internal Affairs report. After hearing plaintiff on the phone, both officers violently grabbed the plaintiff, shoved her into an elevator, and forcibly took her to the lobby and out of the hotel. \n\tPlaintiff told officers Iocco and Del Villar that she would report their misconduct. One of them then grabbed and pulled the plaintiff hard; the other officer then tackled her and pulled her backwards, back into the hotel and across the lobby. One of the officers told the other to calm down and stated, “cameras.” The police officers then accused the plaintiff of trespassing onto the hotel; stated she was emotionally disturbed; placed the plaintiff in handcuffs; and  brought her to the psychiatric unit of a hospital. After several hours at the hospital, the hospital released the plaintiff because it found no basis to involuntarily commit her. Police never charged her with any crime despite their earlier accusations.
