Defendant officers then lifted Plaintiff off the ground and pushed her across the Brooklyn Bridge with her shirt pulled behind her neck, continuing to ignore Plaintiff's requests to pull her shirt down. Defendant officers then pulled Plaintiff's pants down to her ankles, exposing Plaintiff's buttocks and genitals, and the Defendant officers refused to oblige Plaintiff's request to pull her pants back up, continuing to mock and humiliate her. While Plaintiff was standing nearly naked. the Defendant officers forced her to walk from the middle of the Brooklyn Bridge to its end. Plaintiff's request to clothe herself or have a female police officer clothe her were continuously ignored my the Defendants. Defendant Officers then forced Plaintiff to stand nearly naked for approximately 15 minutes before they haphazardly clothed her and placed her in the transport van. The demonstration was orderly and calm, however more police started to arrive to the protest and by 5:25 PM there were fifty police officers including all named defendants, Inspector Dowling, Deputy Inspector Hillery, PO Cascio, PO Cirikiovich, PO Dottavio, PO Johnson, PO Monestine, PO Mosquera, PO Olivares, and PO Singh. At about 5:27 PM, the PO's made an inaudible annoucement over a loudspeaker as Bensmaine noticed other protestors continue to make their way toward 47th street where the officers were located. At 5:27 PM, Bensmaine was in at the crosswalk at 47th street and 7th avenue where he waited for people in front to move out of his way, so he decided to take some photographs of the protest. Bensmaine alleges he was suddenly tackled by at least five of the defendant officers, who then piled on top of him and showed his face into the concrete. Eventually some officers got off of him and Bensmaine attempted to gather himself off the ground and retrieve his credit cards that were spread out on the street when the officer directly on top of him used his baton to push Bensmaine further into the concrete. Several officers crowded around Bensmaine while this was happening without intervening, which also made it difficult for other protestors to see what the POs were doing to Bensmaine. Bensmaine alleges he was violently and tightly zipped tied, then had the zip ties removed only for handcuffs to be tightly placed on his wrists instead. He was made to wait for hours until ultimately being put on a bus and transferred to an arrest processing facility where he waited for hours without food, water, or medical attention and was ultimately issued a pink summons by Police Officer Andre Jeanpierre . Gavin attempted to obey this command and get off the street, but this was practically impossible given the police officers in the way and buses were in the way blocking the sidewalk. Sgt. Matthew Tocco grabbed Gavin’s arm and asked where she thought she was going. Gavin told him she was trying to get to the sidewalk. Tocco told her to “shut the fuck up” while P.O. Gerard Dowling grabbed her right arm. Tocco and Dowling kicked Gavin’s feet out from under her, causing her to hit the ground. Tocco and Dowling placed her in handcuffs. P.O.s had no reason to arrest her, she had been trying to comply with the instructions to leave the street. Gavin did not resist arrest. P.O.s assigned her arrest to Jonathan Calderon, who transported her to One Police Plaza, then to Central Booking. Calderon told her he didn’t understand why she was being arrested and told her she should sue.
