Plaintiff's brother was driving friend to hospital . Several officers including Forrester stopped the car no reason . The officer's searched each member of the group. They also searched the car and allegedly found a plastic bag containing marijuana on the drivers side. The defendants arrested the entire group and took them to the 73rd Precinct.  Forrester arrested the plaintiff with possession of marijuana , even though no marijuana was found on or near him.  The Kings District Attorney's Office decided that they were going to decline prosecution of every member of the group except for the person who was driving which was plaintiff's brother Louinis.  Confusing plaintiff with his brother, the DA Office decided to prosecute plaintiff as the alleged driver and declined prosecution of the other four individuals. Plaintiff was transported to the 73rd precinct where he was again searched, questioned and detained in a holding cell. Several hours later, the plaintiff was permitted to leave only after being issued a summons for an Open Container.
