Plaintiff ALKAIFI was in the bathroom and ACOSTA was stocking the refrigerator when police officers including defendant MUSTAFA and JOHN and JANE DOES 1-10 illegally entered the store. defendants broke down the door to the bathroom and physically hit Plaintiff ALKAIFI on his head. Defendants illegally grabbed and threw both Plaintiffs to the ground. The defendants immediately grabbed the six (6) workers and customers and began manhandling them. They were all thrown to the ground where they were searched and handcuffed. The Plaintiffs were arrested and placed in a van while the police officers searched the store. Plaintiffs were searched despite no probable cause to do so. Defendants alleged to observe a large plastic bag containing khat inside a refrigerator, and eight bags containing marijuana and marijuana cigarettes inside of a black leather jacket located in a room at the said location, knowing said claim to be false. Plaintiffs were never in possession of any khat, marijuana, or any other contraband. Both Plaintiffs were falsely arrested. Defendant MUSTAFA was the arresting officer of ALKAIFI and ACOSTA.\n\nALKAIFI and ACOSTA were subjected to an illegal strip search with a cavity inspection at the police precinct. Said illegal strip search was conducted by Defendants, or at the direction of Defendants. Defendant MUSTAFA was Plaintiffs arresting officer and signed his criminal court complaint, falsely accusing Plaintiffs of Criminal Possession of a Controlled Substance in the seventh degree, and other related charges, all of which MUSTAFA and other defendants knew to be untrue. Defendants false, misleading, and incomplete information to prosecutors. Defendants suppressed evidence and engaged in conduct undertaken in bad faith. Plaintiffs were wrongfully incarcerated for approximately three (3) days, or forty-eight (48) hours, until they were released on or about March 18, 2018. Defendant NYPD detectives Nelson Pena and Bahir Mustafa, entered the barbershop and unlawfully arrested and handcuffed plaintiff extremely tightly, causing substantial injury to his wrists and hands. Defendants Pena and Mustafa eventually took plaintiff Howard to the 48th precinct, after driving him in an NYPD van for over two hours. Plaintiff Montanez was later confronted on the street by defendants Pena and Mustafa, who arrested, handcuffed and searched her without a valid warrant.
