Defendants handcuffed, arrested, transported plaintiff to the 14th Precinct, and placed him in a holding cell. Defendants falsely communicated to the NY DA that plaintiff had committed a crime, and provided the DA with false evidence. On May 7, 2012, plaintiff was transported to Manhattan Central Booking. A criminal prosecution was initiated against plaintiff. After being unlawfully detained for many hours, plaintiff was arraigned and charged with a crime he did not commit. Bail was set at $3,500. Plaintiff was unable to post bail and was remanded into NYC DoC custody. On May 11, 2012, plaintiff was released after he was able to post bail. Plaintiff was forced to return to court on four dates. Plaintiff decided to purchase a designer watch and designer sunglasses, but when he was attempting to make his purchase he was confronted by Defendant NYPD Officer Droesch and two other officers who accused him of using a fake credit card. The officers grabbed Plaintiff's arms and placed him in handcuffs, despite the fact that he denied the allegations and offered to show matching identification. Plaintiff was led to a room within the store where there were holding cells enclosed by metal bars, all of which were occupied by individuals of color. Plaintiff was placed into one of these cells and told to remove his belt, wallet, and backpack, and his cellphone was also confiscated. The three defendant officers proceeded to search through Plaintiff's belongings and were joined by defendant NYPD officer Devirgilio; all of Plaintiff's identification found on his person matched his credit card.
