Plaintiff Lopez began to leave the building soon after entering to play basketball. Plaintiff Lopez saw multiple individuals in street clothes, later determined to be Det Paul Rivera, Lt. Fabian Sanchez, and POs Louis DeFranco and Jose G. Taveras, heading toward the entrance. Plaintiff Lopez held open the door for them with his back turned. POs abruptly rushed Plaintiff Lopez, wrapping their arms around his neck area, forcibly lifting him up, and pushing him forward in the air. Plaintiff Lopez fell approximately 15 feet and landed at the bottom of a step rise. POs then landed on top of Plaintiff Lopez, who at no point had any opportunity to defend himself. Plaintiff Lopez was rendered unconscious and sustained serious injuries including a basilar skull fracture, traumatic subdural hematoma, and pneumothorax. Plaintiff Perez heard the commotion, approached the unknown individuals now known to be POs, and asked what happened to his brother whom he had just been with. Upon learning Plaintiff Perez was with Plaintiff Lopez immediately prior, POs rushed Plaintiff Perez, forcibly grabbed him, and tightly handcuffed him tightly. Plaintiff Perez was ordered to sit down and shortly thereafter POs forcibly pulled him from a seating position and dragged him to their car. Plaintiff Perez was taken to the 10th Precinct where he was criminally processed and subjected to an illegal search. No contraband was found. \n\nDespite Plaintiff Lopez's injuries POs delayed his medical treatment. Eventually Plaintiff Lopez was transported to the hospital, where he was shackled to the bed despite his condition and illegally searched, which did not reveal any contraband. Both Plaintiffs were subject to a malicious prosecution alleging an sale of marijuana. However, Plaintiffs' movements were recorded on CCTV and at no point did they exchange marijuana. Shortly after commencement of the malicious prosecution, Plaintiff Lopez was rushed to another hospital for life saving surgery that required the removal of part of his skull. Plaintiff Perez's case was dismissed on or about September 21, 2016. Plaintiff Lopez's case was dismissed on November 21, 2016. \n\nBoth Plaintiffs suffered and continue to suffer pain, emotional distress, loss of liberty, loss of rights to familial association, and pecuniary damages as a result of this incident. Plaintiff Lopez was looking forward to attending and playing basketball at college.
