On November 15, 2011, Plaintiff was at Zuccotti Park in support of OWS. Officers raided the peaceful protest, during which Plaintiff was tackled to the ground and punched. Plaintiff was dragged through the park resulting in the loss of his clothes and injury. Plaintiff was placed on a bus, handcuffed, and arrested. Plaintiff was charged with Disorderly Conduct and Criminal Trespass which were later dismissed. On May 26, 2012, Plaintiff was in a subway station and witnessed officers approach two minors without cause. Plaintiff then began to record the incident, resulting in the officers tackling and punching Plaintiff when he refused to stop recording. Plaintiff was then arrested for Disorderly Conduct which was later dismissed. On July 18, 2012, Plaintiff was again in the park live-streaming and recorded officers. Officers repeatedly hit Plaintiff's iPad and threatened to arrest him for filming the officers. On July 28, 2012, Plaintiff was inside a subway station with his livestream equipment but was not recording. Officers asked him why he was recording, to which Plaintiff responded he was not, and then Plaintiff entered the subway car and the officers followed. When the train stopped, the officers dragged Plaintiff off the train and began repeatedly punching him.
