Hohn was leaving his employment. As I was crossing from the Northeast corner of 47th Street to the Southwest corner, Plaintiff saw a man walking in his direction. This man was later identified as Nigel Ricketts (Defendants). About ten feet from the plaintiff, Nigel Ricketts yelled at him, “You’re going to give me money !” Nigel Ricketts then, without cause or provocation from the Plaitnff, pushed with both hands the plaintiff, who fell to the ground and hit the left shoulder. The plaintiff suffered numerous fractures of the left humerus. The plaintiff was disabled, lost his hearing, and was put under medical care, other forms of care, and extensive confinement. The plaintiff sued the City of New York and New York City Health and Hospital Corporation for proximately causing the assault to protect Plaintiff and other members of the general public from Defendant Nigel Ricketts. Nigel Ricketts was a homeless and mentally ill individual who, shortly before and on the day of the assault, had been in custody and under the care of the facilities owned and operated by the municipal Defendants. The City of New York and New York City Health and Hospital Corporation undertook to provide and did provide in-patient and out-patient medical care, counseling services, and other services to Defendant Nigel Ricketts and was negligent while doing so. The City of New York and New York City Health and Hospital Corporation failed to treat Defendant Nigel Ricketts according to generally accepted medical and psychiatric standards; failed to heed the danger that Defendant Nigel Ricketts posed to himself, to Plaintiff, and the general public; failed to provide Defendant Nigel Ricketts with proper and adequate mental health care, drug treatment therapy, or clinical supervision; failed to detain Defendant Nigel Ricketts involuntarily in light of his medical history and condition, as it was authorized to do and as it was required to do under the Mental Hygiene Law; failed to provide sufficient post-discharge planning and proper out-patient care; failed to ensure that Defendant Nigel Ricketts took adequate medication. Both the City of New York and New York City Health and Hospital Corporation were negligent in failing to protect Plaintiff and the public from Defendant Nigel Ricketts, who it knew posed a danger to the members of the general public, and specifically to Plaintiff.
