At that time, numerous NYPD Officers, in both plain clothes and in uniform, including, upon information and belief, defendants Elliott and Casianohidalgo, converged upon Plaintiffs and began asking them questions about a fight. Plaintiffs informed them they had no information to provide on the subject. instead of letting plaintiffs go about their day, the defendant officers physically accosted plaintiffs. Plaintiff Alston was thrown to the ground by one or more officers, and Plaintiff Peterson was thrown against a metal fence by one or more officers.\n\nPlaintiffs were both handcuffed and transported to the 23rd Precinct. Plaintiff Alston remained in custody in the 23rd Precinct for approximately 9.5 hours and was released with a summons. Plaintiff Peterson was transported from the 23rd Precinct to Harlem Hospital, where he received treatment for his broken tooth and the gash to his head. X-rays taken at the time also revealed a broken nose and closed tooth fracture. He was then transported to PSA 5, where he was released\nwith a summons. Despite knowing that the charge of Disorderly Conduct against each Plaintiff lacked any factual basis, Defendants, including Officers Elliott and Casianohidalgo falsely and maliciously pursued convictions on the summonses issued to each Plaintiff. Officer Elliott swore to and signed the summons for Plaintiff Alston, while Officer Casianohidalgo swore to and signed the summons for Plaintiff Peterson. Plaintiff Alston made two court appearances before his case was dismissed on September 29, 2020. Plaintiff attempted to walk away but defendant P.O.s Elliott and Aiello continued to follow and push plaintiff. Defendant P.O. Wang ordered his officers to handcuff plaintiff. Several P.O.s surrounded, physically restrained, and repeatedly punched plaintiff. While plaintiff was on the ground, P.O. Zalewski forcefully stomped on the back of plaintiff's head, which caused heavy bleeding. Some defendants further positioned themselves to obstruct cameras from recording the incident. At the precinct, plaintff's repeated requests for medical attention were denied. Moreover, defendant P.O. provided false statements to the District Attorney's Office regarding plaintiff's location during his brother's arrest. Melhado, Ivonne Ramirez, Sergeant Ghibaudi, and two unnamed officers pulled over the taxi with their weapons drawn, forcibly removed plaintiff from the car, and arrested plaintiff without cause.  The officers tightly handcuffed plaintiff with his hands placed behind his back.  The officers forcibly placed plaintiff inside their police vehicle and transported him to the 23rd Precinct, where he was interrogated and had DNA unlawfully collected from him.  At the precinct, the officers placed plaintiff inside a cell, handcuffed him to a pole, and seized his phone without providing any voucher for plaintiff to reclaim his property.  The officers have since refused to return any of his properties.  Plaintiff did not possess any weapons and did not commit any offense, but the defendant officers falsely stated to the prosecutors that plaintiff was in possession of a weapon. The prosecutors conducted an independent investigation and concluded there was no evidence of a crime, so they declined to prosecute the plaintiff.
