Plaintiff was a passenger in the vehicle and the vehicle was stopped by defendant officers Tyler Hanson and Sgt Jonathan Riviera with no probable cause. Plaintiff and others were ordered out of the vehicle and handcuffed without just cause and they complied with the officers. The vehicle was driven by a navy seal who was authorised to posess a firearm and he explained this to the officers. Plaintiff was arrested despite this and charged with criminal possession. Plaintiff was unaware when he entered the vehicle that there was a gun in it. The car had California licence plates as the driver had just moved from there to New York and explained this to defendant officers also. Plaintiff was driven to precint and arraigned after being held for 24 hours. He was then taken to central booking and held for two days before being charged. He was then held incarcerated for 48 hours until he was able to pay bail. Plaintiff was wrongfully searched, seized, detained and incarcerated by defendants. Plaintiff suffered emotional distress from his three day incarceration. Defendants knew or should have known their actions would cause serious emotional distress/pain. Plaintiff did not get fair due process and was maliciously prosecuted. Raymond Rivera was not told why he was being held, nor was he given an opportunity to make a phone call or offered any food. No charges were lodged against plaintiff Raymond Rivera resulting from this traffic stop.
