Officer Theobold then seized and handcuffed plaintiff and brought him out into the hallway.\n\nIn the hallway a Chinese person, who may have been the victim of a robbery by two men, was present.  Plaintiff was arrested at this time, despite the fact that he was not identified as one of the two individuals who had robbed the Chinese person.  Plaintiff was subsequently held in jail for approximately one day before being arraigned on robbery and other charges and released. He was detained by his car when the officers searched his car without justification or cause. No narcotics, drugs or contraband were found in his car. The officers ordered Plaintiff back inside the car and asked for his license. After presenting his license, officers Gisbert and D'Amico came over to Plaintiff. Officer Gisbert ordered him out of his car. An officer handcuffed him and searched him without finding any drugs, weapons or contraband. The handcuffs were extremely tight but the officers ignored Plaintiff's request to loosen the handcuffs. In order to cover up their illegal actions, the officers maliciously told the DA's Office that Plaintiff had committed crimes, including unlawful possession of marijuana. They made these false allegations to cover up their misconduct, meet productivity goals and quotas, and/or justify overtime expenditures. The unlawful actions against Plaintiff were also based on racial profiling or indifference. Plaintiff's case was dismissed on March 25, 2013.
