At the aforementioned place and time, Shandale, accompanied by his brother Richard, was visiting his girlfriend’s apartment. Plaintiffs were getting ready to leave when they heard a knock at the door. Shandale’s girlfriend, walked towards the door and asked “who,” at which point the defendant officers in a demanding and threatening tone ordered that she open the door. When Shandale’s girlfriend cracked the door, Plaintiffs were confronted by five to six uniformed officers. Defendant officers asked Shandale’s girlfriend if everything was alright, and she confirmed that everything was fine. Nevertheless, and without probable cause or legal justification defendant officers asked Plaintiffs to step out of the apartment. Plaintiffs complied without hesitation. Once in the hallway, Plaintiffs asked why they were asked to step out, suddenly and without any legal justification defendant officers Gutic, Rodriguez and Montero grabbed Richard, held him down on the ground and tasered him multiple times. Shandale demanded that the officers stop their brutal and unnecessary attack, at which point he was struck two times in the head with a closed fist by one defendant officer. Plaintiffs were then unlawfully searched, placed in unreasonably tight metal handcuffs while on the ground, taken downstairs, and placed in the back of an NYPD vehicle. At no time relevant herein did Plaintiffs commit a crime or violate the law in any way, nor did the police officers have an objective reason to accuse Plaintiffs of committing a crime or violating the law in any way. At no point did defendant police officers recover any drugs, weapons, or other illegal contraband from Plaintiffs or from a location that was in Plaintiffs possession, custody, or control.Plaintiffs did not resist arrest. Nevertheless, Plaintiffs were unlawfully arrested, handcuffed, and subjected to unlawful pat-down search by the defendant officers without legal justification or probable cause. Plaintiffs were thereafter transported to the 42nd Precinct against their will.\nAgain, at the precinct Plaintiffs were again unlawfully searched, fingerprinted, photographed, and placed in a holding cell. After several hours in custody Richard was given a Desk Appearance Ticket and released. Shandale was transported to Central Booking, where he was again processed and detained in a holding cell. Neither plaintiff, despite their obvious injuries and poor physical condition were rendered medical aid by the defendant officers.\nWhile plaintiffs were in custody, the defendant police officers provided the Bronx County District Attorney’s Office with the false, misleading, and/or incomplete information that Shandale had committed crimes, specifically that he was engaged in assault in the second (2) degree, resisting arrest, obstructing governmental administration, and other related charges. The following day, Shandale was arraigned in criminal court, charged with the crimes he did not commit, and released on his own recognizance. On or about February 9, 2023, all charges made against the Plaintiffs were dismissed and sealed in their entirety as there was insufficient evidence.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=MecT/2AZ3/RB1w9i/q1/SA==","type":"complaint"}]}],"id":"3QVM","url":"https://www.50-a.org/officer/3QVM"}
