The defendants then proceeded to forcibly and unnecessarily twisted his arms to handcuff him. As a result of the actions of Rosado and Doe, Mr. Luker experienced a fracture of left wrist and arm, substantial pain and swelling. At no time did Plaintiff engaged in any criminal or unlawful conduct, including sexually abusing the woman or resisting arrest.\n\nAfter his arrest, Mr. Luker was transported to the 52nd NYPD Police Precinct, where he was placed in a cell with other males for several hours. While at the Precinct, Mr. Luker was subjected to a strip search and nothing illegal or unlawful was recovered. After being held in a cell inside of the 52nd Precinct for several hours, Mr. Luker was transported to a local Bronx hospital where he received medical treatment. After receiving medical treatment for several hours at the local Bronx hospital, he was then transported to Bronx County Central Booking located at 215 East 161 Street, Bronx, NY and placed in a cell with other male individuals. On October 30, 2019, Mr. Luker was arraigned in Bronx County Criminal Court and charged with Forcible Touching, Sexual Abuse in the Third Degree, Harassment in the Second Degree and Resisting Arrest. At the time of his arraignment, Mr. Luker was released on his own recognizance and ordered to return to Court.
