A few minutes after midnight, June 29, 2011, numerous members of the NYPD responded to the nightclub and ordered everyone to exit the nightclub. Plaintiff Pena complied with with orders to leave and walked towards the exit. Officers McDougall and Chau grabbed Pena from behind, and punched and kicked, and struck Pena with a baton all over his body. Pena was then thrown to the ground and sprayed in the eyes with mace. Pena was arrested and placed in tight handcuffs. \nPlaintiff Diaz complied with orders and exited the nightclub. While walked away from the nightclub, Officer Diaz pushed Plaintiff Diaz and then Officer Szeto grabbed and shoved Diaz. Diaz was struck with a baton and punched and kicked by the officers.\nPlaintiff Ayala was outside the club and complied with orders. She tried to film the melee outside the club. Ayala was approached by officers and struck in the head and face, causing her to drop her camera.  \nPena and Diaz required medical attention at Bellevue Hospital. When the bar refused to lower the music, plaintiff continued to complain and the bar called the police. Plaintiff was tightly handcuffed. Plaintiff was strapped to a gurney and placed in an ambulance and took her to Bellevue Hospital where she remained for approximately 13 hours before she was allowed to leave. The undercover officer, dressed in very short shorts and other indicia of street prostitution, clutched his arm and begged him to sell her drugs. Plaintiff shook her off and walked on. She grabbed his arm again, pleading she was sick and needed the drugs. He shook himself free of her once more, yelling at her to stop bothering him; she was a mess; she should get into a program. He started across the street to get away from her. She screamed expletives at him, threatened him, called out that he didn't know who he was dealing with. Plaintiff continued across the street to his home. When he approached the door several police officers in plain clothes pounced and arrested him. He was taken to a local precinct for approximately 18 hours, then moved to central booking. The next day he was charged with PL 195.05, obstruction of governmental administration in the second degree. Bail was set at $1000, which he could not raise. He was moved to Rikers Island. The case was finally dismissed on March 13, 2012.
