Defendants, including Juan Peralta and John and Jane Doe 1-10 demanded Plaintiff's driver's license and then falsely claimed that Plaintiff's bicycle was illegal, and that Plaintiff was not allowed to ride it on the sidewalk. The plaintiff was not riding on the sidewalk but had stopped to talk to a friend. Plaintiff informed that said bicycle was legal and designed for children's use, and that a driver's license was not required to operate said bicycle. Plaintiff provided the Defendants his New York State ID card. Defendants falsely claimed that the Defendant had an expired driving license and arrested the Plaintiff on erroneous claim of driving on the sidewalk with an expired license. Defendants arrested plaintiff and restrained him with excessively tight handcuffs which caused physical discomfort and was transported to the 42nd precinct. Defendants did not observe Plaintiff commit any crimes. At the precinct Plaintiff was illegally searched, questioned, photographed and fingerprinted by the Defendants. Defendants provided fabricated evidence to prosecutors, namely that Plaintiff had an expired license and that his bicycle was not a permissible street vehicle. Defendant Peralta directed the unfounded criminal investigation against plaintiff to exact retribution upon plaintiff's prior successful lawsuit against the officer which resulted in disciplinary action levied against him. Plaintiff was arraigned and formally charged with Aggravated Unlicensed Operation of Motor Vehicle, and related charges. On November 25, 2019, all charges were unconditionally dismissed and sealed.
