Officer Murphy opened the passenger side door of Hassler's vehicle and woke her up, and Officer Nanayakkara asked if she had anything to drink that night, to which Plaintiff responded \"no.\"  Officer Nanayakkara told Officer Murphy multiple times that he did not smell alcohol on Hassler's breath and that she just looked tired.  Despite this, Officer Nanayakkara and Officer Murphy continued to detain Hassler until a portable breathalyzer test arrived.  When Hassler declined to submit to the breathalyzer test, Officer Nanayakkara and Officer Murphy arrested Hassler and brought her to the 123rd Precinct.  Hassler was charged with driving while intoxicated and driving while ability impaired.  In the criminal complaint against Hassler, Officer Nanayakkara alleged that he smelled a moderate odor of alcohol on Hassler's breath.  Hassler was incarcerated for two days prior to her arraignment.
