Also present in the car was a second Caucasian man. The car was stopped by police officers. The three men were ordered out of the car at gunpoint. Plaintiff complied, and asked what was happening. Plaintiff was not engaged in any criminal conduct or in possession of any contraband. In response to Plaintiff’s question, one or more of the officers moved to strike Plaintiff and put him in handcuffs. During the incident, Plaintiff was also, inter alia, grabbed by, on information and belief, PO Serafin Resto, who proceeded to forcefully punch Plaintiff in the face so hard that the officer fractured one or more of the bones in his hand. Additional officers joined PO Resto in beating Plaintiff as he lay on the ground. Several of Plaintiff's front teeth were cracked and fractured, permanently disfiguring him. Plaintiff also suffered a bruised eye, additional bruises, lacerations and injuries. He thereafter also suffered from blurred vision in one eye. Officers did not similarly detain or brutalize the two Caucasian individuals otherwise similarly situated to Plaintiff, although they were actually found to be in possession of unlawful narcotics. \n\nPlaintiff was transported to a police precinct, where he was held for several hours before being transported to a hospital for medical treatment. Upon arriving at the precinct, Plaintiff was searched. The search revealed no contraband. Plaintiff was charged with felony sale of a controlled substance, and assault on a police officer, among other crimes and offenses. On information and belief, both of the Caucasian individuals present in the car were in possession of quantities of heroin, and made a deal with the police to falsely accuse Plaintiff of having sold them the drugs and were later released from custody with Desk Appearance Tickets. The police officers made false allegations against Plaintiff. PO Resto falsely alleged that he saw an exchange of some sort between Plaintiff and one of the two Caucasians in the front seat of the car before police approached the vehicle. POs Erik Nelson, Eric Sonnenberg, Resto and Brian Ritto complained, or made false allegations, about Plaintiff assaulting them; upon information and belief, those claimed injuries were sustained while unjustifiably beating Plaintiff.
