Plaintiff observed Defendant Officer Mahlung ticketing the vehicle. Plaintiff approached and spoke with Defendant Officer Mahlung and he was issued a Notice of Parking Violation and swore that Plaintiff hit him. Other NYCPD, including Defendant Officer Joseph arrived and at around 4:38PM, Plaintiff was placed under arrested. Plaintiff was released on June 26, 2012 and had directions to appear in court on September 4, 2012. At his arraignment, Plaintiff learned he was charged with Obstructing Governmental Administration in the second degree and Harassment in the second degree. \n\nOn July 2, 2012, Defendant Officer Mahlung swore under penalty of perjury to the truth of the allegations in the criminal court complaint. The NYC DA’s office received a video of the entirety of the interaction and no physical contact had occurred.
