Officers Jason Vasquez, David Pabon, David J. Demelia, Mark Oconnel, and others, then took Plaintiff to the holding cell area of the 46th Precinct. The officers, in particular, David Pabon, forced Plaintiff to stand in front of the female holding cell and conducted an unlawful strip search, where he sexually assaulted and abused Plaintiff by opening Plaintiffs’s pants, sticking his hand inside Plaintiff’s boxers, and fondling and squeezing Plaintiff’s testicles and penis. The officers, in particular, David Pabon, failed to disclose and report and covered up such abuse and assault.\n\nOn or around November 18, 2020, Plaintiff was falsely arrested by Detective Jason Vasquez and was charged with Criminal Possession of a Controlled Substance in the Seventh Degree. However, Plaintiff did not possess or attempt to possess a Controlled Substance. Instead, the officers deliberately planted envelopes containing substance, which allegedly was heroin, on Plaintiff. The officers knew so but nonetheless charged him with the crime to conceal their own unlawful and grossly improper use of force and in retaliation as a result of Plaintiff complaining about their prior abusive, sexual assault, and improper acts. The officers, in particular, Jason Vasquez and David Demelia, submitted false and misleading police reports and statements to the DA’s office. Demelia, and John or Jane Doe 1-10, who targeted Plaintiff for adverse police action due to Plaintiff's race. POs forcibly struck Plaintiff with their knees to his ribs and their elbows in his back, throwing him to the floor. At no time did Plaintiff exhibit a reason to strike him, and at no time prior to Plaintiff being struck did POs identify themselves as POs. POs then conducted an illegal search of Plaintiff's person in view of bystanders. POs fabricated a false narrative that Plaintiff had committed drug offenses, a practice endorsed by these POs previously. Plaintiff was brought to the precinct and central booking, eventually being released after 19 - 20 hours in unlawful detainment. \n\nPO Humphrey signed a fabricated criminal complaint against Plaintiff to initiate a malicious prosecution.
