NYPD officer Tuhin Khan and his partner arrived on the scene. The other driver accused plaintiff of being intoxicated, which plaintiff denied. Khan requested plaintiff take a Breathalyzer test at the precinct, which showed there was no alcohol in plaintiff's system. A third officer stated he believed plaintiff was under the influence of drugs, which plaintiff denied, completing a series of coordination tests without issue. A highway patrol officer then claimed that a black light revealed the presence of a white powder substance on plaintiff's face. Khan then told plaintiff that he was under arrest on suspicion of driving under the influence of drugs, which plaintiff denied. Plaintiff was then transferred to the 32nd Precinct for processing, where he complained of a bad headache and feeling dizzy. Plaintiff was brought to Harlem Hospital in handcuffs. Plaintiff had his blood tested, revealing that there were no drugs in his system. Medical staff informed officers present that plaintiff was likely suffering from a concussion and/or stroke and asked them to remove the handcuffs, but the officers refused and stated that plaintiff was under arrest. Doctors eventually confirmed plaintiff was suffering from a stroke, and officers refused to remove the handcuffs or leave his side even though medical staff made it clear he needed to be fully ambulatory for treatment.
