Officer Fidanza was working undercover as part of a prostitution sting, and proceeded to offer the Plaintiff sexual services for a monetary fee. The Plaintiff, who was stopped at a stop sign when he was approached, declined the offer and informed Officer Fidanza that he believed she was a police officer. The Plaintiff turned down the street, at which time he was ordered to pull over by other members of the NYPD, including Defendant Stephanie Cepeda, who upon information and belief, were responding to a signal from Defendant Officer Fidanza. The Plaintiff was ordered to exit his vehicle, then he was searched by members of the NYPD and placed under arrest by Officer Cepeda. The Plaintiff was transported to a local precinct and then to Central Booking, where he was searched, photographed, and fingerprinted by members of the NYPD. \n\nThe Plaintiff was eventually arraigned and charged with violating Penal Law Sections 240.37 and 230.03, based on the sworn Criminal Court Complaint of Defendant NYPD Officer Shareen Grant who was informed by Defendant Officer Fidanza of the Plaintiff's alleged conduct. Despite that Plaintiffs were not found in possession of any contraband and had not committed any crimes or offenses, Defendant Officers placed them under arrest and then proceeded to ransack Plaintiffs’ apartment, destroying their personal property. Plaintiffs were taken to the 41st precinct. After approximately 13 hours in custody, plaintiff S.B. was released. Plaintiffs Luis Martinez and Cherise Martinez were taken to central booking and Defendant Officers, including Fidanza, Balicki, Edouard, Rivera and Pasquale, fabricated police paperwork and falsely charged Plaintiffs with possession of contraband.
