Parole officer Brathwaite concocted a false story, with malice, that plaintiff was committing non-existent crimes, claiming she received information from a police officer whom she made up, that plaintiff was engaged in criminal activity. As a result, police officer Alicia Commisso, parole officer Patrice Brathwaite and other unidentified officers went to plaintiff's halfway house, immediately handcuffed plaintiff and placed him  under arrest for the non-existent crimes. The officers then searched the entire basement of the halfway house, where plaintiff's bedroom was located. The officers also searched plaintiff. No contraband was found. Plaintiff was then taken to the precinct and booking, where the officers provided the DA with false, misleading and/or incomplete information that plaintiff committed a crime, made sure that no amount of monetary bail could get plaintiff released and lied in the Grand Jury to secure an illegal indictment. During the evidentiary hearing, the judge found that parole officer Braithwaite acted fraudulently and plaintiff was released from incarceration, after spending 16 months unlawfully incarcerated. All charges against plaintiff were dismissed and sealed. During his time illegally incarcerated, plaintiff was assaulted numerous times by corrections officers and other dangerous inmates, including being pepper sprayed at least 5 times.
