Plaintiff is a counselor at the facility. Plaintiff was attacked by a client at Lifespire. The client bit, choked, and scratched her and continued to act dangerously. Plaintiff called the police. When the police arrived, they arrested the client, but Defendant Police Officer McMahon taunted Plaintiff, saying that she was not competent to handle her job. She obtained Defendant McMahon’s badge number. Minutes later, police officers came back to the facility and, in apparent retaliation for Plaintiff demanding Defendant McMahon’s badge number, arrested Plaintiff for assault. After spending numerous hours in custody, the District Attorney’s office declined prosecuting the case, and Plaintiff was released. During the events described above, the Defendant police officers failed to intervene in the obviously illegal actions of their fellow officers against Plaintiff.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nyed.346818/gov.uscourts.nyed.346818.1.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/13050102/banks-v-city-of-new-york/"},{"name":"Campbell, Althea, et al. vs City of New York, et al.","start_date":"2013-05-14","disposition_date":"2013-09-17","payout_amount":0,"disposition":"Zero Disposition","docket":"13CV02392","court":"U.S. District Court - Eastern District NY","officer_name":"McMahon, James","summary":"On 12/30/2022, at approximately 6:30pm, plaintiff Alpha Balde, was lawfully in the vicinity of East 141st Street, Cypress Avenue, Bronx, NY, doing nothing illegal or, suspicious or improper when defendant NYPD officers Bernardo Tejada, Ivan Cruz, John Doe and John Roe, absent a warrant, probable cause or any legal justification, approached Plaintiff and stopped, strip searched and detained him in an aggressive manner with excessive force.
