Plaintiffs were approached by Defendant Officers Green and Nigro, one of whom repeatedly punched Plaintiff Pelt in the head and face, threw him to the ground, repeatedly kicked him in the leg, repeatedly struck him with an ASP metal retractable baton on his arm and back, and handcuffed him.  Plaintiff Simms left the location to look for Plaintiff Pelt's mother; upon his return, Defendant NYPD Officers including Corlino grabbed Plaintiff Simms' head, slammed his head into a wall, twisted his arms behind his back, and handcuffed him.  While Plaintiff Simms was handcuffed, Defendant slammed him on the ground and repeatedly struck him with an ASP on the back.  Without any cause, the officers handcuffed and arrested the Plaintiffs.  Plaintiffs Simms and Pelt were imprisoned until September 21, 2012, when they were arraigned on baseless charges based on the false allegations of Defendant Officers Castiglia, Corlino, Green and Nigro.  Defendants initiated the prosecution to avoid punishment for their acts of brutality and abuse of authority, and they created and gave to the prosecutors false evidence, including false allegations that the Plaintiffs acted disorderly and resisted arrest.  On April 30, 2013, all charges against Plaintiff Pelt were adjourned in contemplation of dismissal and subsequently dismissed and sealed.
