Plaintiff slid his MetroCard through the turnstile and gained entry to the subway platform. Plaintiff and his coworker walked along the subway platform when they were approached by Defendant officers Cuadrado, Lombardi, and Botto. At this point, Defendant officer Cuadrado handcuffed and arrested Plaintiff without probable cause or legal justification.  Defendant officers then escorted Plaintiff out of the subway station and placed him in a police car. While in the police car, Plaintiff asked the officers if they could loosen his handcuffs since they were too tight and were causing pain. Defendant officers refused Plaintiff’s request. Plaintiff was then brought to the 5th precinct for booking. Plaintiff was held in central bookings until 4:00PM on February 28, 2013, at which point he was told that the district attorney declined to prosecute his case.
