Plaintiff walked outside and asked the defendant officers to leave the premises. The defendants became more unruly, then sped out of the parking lot. The officers made a U-turn and parked in front of the deli. The defendants got out of the car and Plaintiff immediately apologized stating he did not know the defendants were police officers. The defendants demanded Plaintiff’s identification. Plaintiff inquired why they needed his identification. One of the officers replied, “either you give me your ID, or I’m going to get the entire precinct down here and get it from you.” A minute later, approximately 20 police officers arrived at the deli. The officers surrounded and menaced the Plaintiff. The officers grabbed the Plaintiff, handcuffed him, punched him, and placed a knee on his neck. The officers then continued to kick, punch, and choke the Plaintiff.
