Plaintiff denied that the bag was his and was taken to the 9th Precinct where he was questioned throughout most of the day about incidents in the are, and eventually processed and arraigned. Plaintiff was remanded to \"The Tombs\" (unclear of the location referred to in the complaint) for approximately 7 to 8 days where it was determined that the lab found the substance in the bag to be inconclusive. On January 26, 2017, the ADA motioned to dismiss the case against the plaintiff. Plaintiff was released but was unable to get his employer to employ him again as a barber and lost his job. He saw a police car with its lights on, so he attempted to wave to the officer to ask if he could continue walking on a certain street, but the officer ignored him.  Plaintiff continued on his way, when he was suddenly confronted by another officer who accused him of failing to follow instructions.  Plaintiff responded that he did not understand what the officer was talking about, and the officer then proceeded to search plaintiff.  Multiple officers then threw plaintiff to the ground, kicked him, and stepped on his hand, resulting in a dislocated shoulder and other injuries.  Plaintiff was arrested and charged with Obstruction of Governmental Administration and Resisting Arrest, spending approximately 80 hours in jail before being released at arraignment. The officers arrested the plaintiff for obstructing governmental administration, disorderly conduct, and resisting arrest. A jury trial occurred July 7-9, 2015, before Justice Gilbert Hong.
