Despite the absence of any evidence of wrongdoing by the Plaintiff, the defendants applied excessively tight handcuffs, formally arrested the plaintiff falsely accusing Plaintiff of criminal possession of weapon and breaking into cars, illegally seized Plaintiff’s person with their outstretched hands aggressively grabbing him about his head and body before unlawfully searching his person by rifling their hands in and out of Plaintiff’s clothing and personal belongings and transported him to a local precinct.  While plaintiff was in custody at the precinct, PO defendant Ruiz and others prepared and filed false paperwork with the DA charging the plaintiff with criminal offense of possession and sale of narcotics. All of the plaintiff’s charges were eventually dismissed and sealed on or about December 13, 2020.
