The testimony given there was to the effect of illegal firearms previously or currently in the possession of someone at 108-25 154th Street. There are questions around if the C.I. provided truthful information in regards to the resident of that address. As a result, the judge signed a \"no knock\" search warrant. Prior to the incident date, the plaintiff has been in contact with the NYPD to discuss a neighborhood gun buyback. Plaintiff removed a shotgun and handgun from a family member's home and disassembled it in anticipation of following through with the gun buyback. On the morning of the incident date, the defendants executed a search of the incident address. In the end, the Queens Gang Squad found narcotics, drug paraphernalia, and the guns. Plaintiff was arrested and released on bail. Due to the arrest, the plaintiff was suspended from his Department of Education job and coaching positions. Plaintiff alleges that the narcotics found at his residence had to have been planted by the police. In one meeting with the Assistant District Attorney, he was told to never bring it up again or he would jeopardize any possible positive resolution of the case. Months later, the plaintiff received a plea bargain to a misdemeanor weapons possession charge and pleaded guilty. He named the Plaintiff as the unnamed gun seller, despite the fact he was obviously not the gun seller due to many physical differences. \n\nOn August 4, 2015, Plaintiff was accosted by 15 uniformed and plain clothed members of the ATF and NYPD, including defendants Thomas Kalogiros, John Barratt, Michael O'Brien, Andrew Thorne, and Stephen Millwater, who unlawfully invaded his home and arrested him. The defendants entered the house en masse with guns drawn, in riot gear, and as soon as they saw the plaintiff, they knocked him on the ground, twisted his arms behind his back, placed their weights on his back, slammed his face down to the floor, and held him while they put handcuffs on him as his father, mother, wife, and child watched. \n\nAt no time during the process did the police officers tell the plaintiff why he was being arrested. \n\nThroughout the process of the prosecution, the defendants fabricated evidence and falsely testified as to the Plaintiff's identity as the unnamed gun seller.
